TO ENTER
- Forward the
official Elwood Sundown in Miami e-mail to as many friends or family as you
can. (Do Not Send The Mail To People
That You Do Not Know As You Will Be Breaking Anti-Spam Laws.)
- Email the list of
all the email addresses that you forwarded the Sundown email to href="mailto:[email protected]">[email protected]. (These emails will not be used in any way but to judge the
winners of the contest)
- Sponsor not
responsible for telecommunications, network, electronic, technical or computer
failures of any kind, for inaccurate transcription of entry information, for
any human error, or for entries that are stolen, misdirected, garbled, delayed
by computer transmissions, lost, late, damaged, or postage due.style="mso-spacerun: yes"> All entries become the property of the
Sponsor and will not be acknowledged or returned. All entries must be received by 11:59 PM Eastern Time on August
11, 2000. Entrants must be the
registered subscriber of the email account from which the entry is made.style="mso-spacerun: yes"> The registered subscriber is defined as the
natural person who is assigned to an email address by an Internet access
provider, online services provider, or other organization that is responsible
for assigning e-mail addresses or the domain associated with the submitted
e-mail address. Palm Pictures may
request proof that any potential winner is the authorized account holder of the
e-mail address associated with any potential winning entry.
2. ELIGIBILITY
The sweepstakes is open only to legal residents of the
United States, thirteen years and older as of August 4th, 2000
EXCEPT for the Grand Prize, whereby the winner must be AT LEAST eighteen years
and older as of August 4, 2000. The
sweepstakes is not open to employees of Palm Pictures, or any of the
participating sponsors, affiliated agencies or promotion partners, their
immediate families (defined as parent, grandparents, spouses, siblings,
children and grandchildren) or those living in the same household of any of the
ineligible parties described above. The
sweepstakes is void where prohibited by law, rule or regulation.style="mso-spacerun: yes"> All federal, state and local laws, rules,
and regulations apply.
3. SELECTION OF
WINNER
The winners will be selected based on the highest number of
email addresses that the eligible entrant has forwarded the official ?Sundown
in Miami? contest email to. The winner
will be selected on or about August 15th, 2000.style="mso-spacerun: yes"> The winner will be notified by e-mail.style="mso-spacerun: yes"> If a winner cannot be contacted by any of
these means within ten (10) days of the drawing, an alternate winner will be
selected based again on the highest number of emails sent during the
campaign. Winner will be required to
sign and return to Sponsor an affidavit of eligibility and liability and
publicity release within 14 days of notification. In the event of non-compliance with any of these requirements,
the prize will be forfeited, and an alternate winner will be selected based on
the highest number of emails delivered from the remaining eligible
entries.
4. PRIZEstyle='mso-tab-count:2'>
If, and only if, the ?Sundown? video appears on the MTV TRL
Top Ten videos during the week of August 4th to August 11th,
One (1) Grand Prize winner will receive a trip for two (2) to Miami,
Florida. Such trip includes two (2)
round trip coach class airline tickets from anywhere within the continental
United States as well as 2 nights of hotel accommodations at a hotel of the
Sponsor?s choosing. All other
incidentals, such as meals, transportation to and from home, airport, hotel,
tips, taxes, phone calls, etc., are the sole responsibility of the winner.style="mso-spacerun: yes"> All taxes, fees, surcharges and all other
expenses associated with the acceptance and/or use of the prize are the sole
responsibility of the winner. Prize is
subject to airline tickets and hotel room availability, must be booked with at
least 14 days notice and must be redeemed by August 1, 2001.style="mso-spacerun: yes"> No cash substitution or transfer of prizes
is permitted, except that the Sponsor reserves the right, in its sole
discretion, to substitute a prize of equal or comparable value, in the event
the prize cannot be awarded as described for any reason.style="mso-spacerun: yes"> In the event the Grand Prize winner is under
the age of 18, they will automatically be awarded the second place prize and
the highest number of emails sent by an entrant 18 years or older will be
awarded the Grand Prize.
Regardless of whether or not the ?Sundown? video appears on
the MTV TRL Top Ten list, One (1) First
Place Winner will receive a Sony Playstation.
Regardless of whether or not the ?Sundown? video appears on
the MTV TRL Top Ten list, One (1) Second Place Winner will receive an Elwood
pack which includes the Elwood ?Parlance Of Our Time? CD, a ?Sundown? DVD
single, and Elwood T-shirt, and Elwood hat.
5. PRIVACY
By entering the sweepstakes, you agree to the use of your
personal information (your name, e-mail address, mailing address, or any other
information that may be used to identify you) for marketing purposes by Palm
Pictures or its affiliates.
6. WINNERS LIST
To receive a list of winners (available after August 15,
2000), send a self-addressed, stamped envelope to Elwood?s Sundown In Miami
Contest c/o Palm Pictures, 4 Columbus Circle, 5th Floor, New York,
NY 10019 Attn: Winners List.

Winner assumes all liability for any injury or damages
caused or claimed to be caused by his or her participation in the Sweepstakes
and/or acceptance and/or use of any prize, and release Palm Pictures, its
officers, directors, and employees, from any such liability.style="mso-spacerun: yes"> Sponsor and its agencies assume no
responsibility for any injury or damage to participants or to any other persons
computer relating to or resulting from entering or downloading materials or
software in connection with this sweepstakes.
Sponsor and its agencies are not responsible for any technical,
hardware, software, or telephone malfunctions of any kind, lost or unavailable
network connections, or failed incorrect, incomplete, inaccurate, garbled or
delayed electronic communications caused by the user or by any of the equipment
or programming associated with or utilized in this sweepstakes or by any human
error which may occur in the processing of the entries in this
sweepstakes. Entry constitutes
permission (except where prohibited by law) to use winner?s name, city, state,
likeness and/or voice for the purposes of advertising, promotion, and publicity
without additional compensation.

transmission of this sweepstakes and award the prize from among the eligible
entries received prior to the date of withdrawal. Entrants agree to abide by the Official Rules and by the
decisions of the judges, whose decisions are final. Failure to comply with these rules may result in disqualification
from this sweepstakes promotion.
Sponsor reserves the right to permanently disqualify from any
sweepstakes any person it believes has intentionally violated these rules.
9. GENERAL
INFORMATION
This sweepstakes is conducted in English (which will be
given its everyday ordinary meaning) and any and all disputes will be resolved
in the appropriate courts of the State of New York. Any disputes will be determined under the laws of the State of
New York and in the event there is a conflict between the laws of the State of
New York and the laws of any other jurisdiction, the conflict will be resolved
by applying the laws of the State of New York without regard to its conflict of
laws rules.
